All residential and commercial contractors are required to be licensed by the state of Arizona unless they fall under the handman exemption for projects which require no building permit and are less than $1001. for the total contract price which includes materials no matter if the homeowner buys them and all labor. In addition homeowners using licensed residential contractors may have access to the Residential Contractors Recovery Fund if the contractor is unable and or unwilling to perform the job and if alternative dispute resolutions available through the Registrar are unsuccessful. Advertising Requirements for all Contractors.
The advertising requirements of the statute does not prevent anyone from placing an ad online, in the yellow pages, on business cards, or on flyers.
What it does require under A.R.S. §32-1121A14(c), is that the advertising party, if not properly licensed as a contractor, disclose that fact on any form of advertising to the public by including the words "not a licensed contractor" in the advertisement.
Again, this requirement is intended to make sure that the consumer is made aware of the unlicensed status of the individual or company.
Contractors who advertise and do not disclose their unlicensed status are not eligible for the handyman's exception.
32-1165. Advertising; effect of; classification
Except as authorized by section 32-1121, subsection A, paragraph 14, subdivision (c), it is a class 1 misdemeanor for any person to advertise that he is able to perform any service or contract for compensation subject to regulation by the registrar under the terms of this chapter unless a license under the terms of this chapter is first obtained regardless of whether his operations as a contractor are otherwise exempt.
